BC FIPPA 2023

British Columbia Freedom of Information and Protection of Privacy Act (FIPPA/FOIPPA).

Applies to BC public bodies including provincial government ministries, municipalities, Crown corporations, school boards, health authorities, universities, local police, and self-governing professional bodies. Since February 2023, requires mandatory privacy management programs (PMP) and privacy breach notification to the BC OIPC and affected individuals without unreasonable delay when a breach could reasonably result in significant harm.

Fines up to $500K for corporations and $50K for individuals who fail to report unauthorized disclosures. Since the November 2021 amendments, personal information may be stored outside Canada, but a privacy impact assessment is required for every initiative and a documented risk assessment before sensitive personal information is stored outside Canada.
